# Terms and Conditions What applies when you request a consultation or book an appointment with us via progreen.lu. ## 1. Scope These terms and conditions apply to the use of the progreen.lu website and to enquiries and appointments between Progreen S.à r.l. (hereinafter “Progreen” or “we”) and its customers. For purchases, installation, maintenance and repair, the terms agreed in the respective quotation or order apply in addition and take precedence over these terms and conditions. ## 2. Description of services Our website lets you request a consultation or an appointment for our services: consultation, installation, maintenance and repair of robotic mowers, as well as garden services. The presentation of our products and services on the website does not constitute a binding offer. The scope and price of a service are agreed with you individually. ## 3. Booking appointments You can request an appointment via the [contact form](https://progreen.lu/en/contact), by phone or by email. An appointment is only agreed once we have confirmed it. Availability may vary depending on demand and capacity. Visits to our premises are by appointment only. ## 4. Commitment By confirming an appointment, you undertake to keep it at the agreed time. For appointments at your premises, you ensure that we have access to the property and to the equipment concerned. ## 5. Cancellation and rescheduling Appointments can be cancelled or rescheduled free of charge up to 24 hours before the agreed time. If an appointment is cancelled later, or missed without cancellation, we may charge a reasonable cancellation fee, provided we informed you of this when the appointment was made. If we have to cancel an appointment, for example due to the weather or illness, we will let you know as early as possible and suggest a new date. The statutory rights of consumers, in particular any right of withdrawal under the Luxembourg Consumer Code (Code de la consommation), remain unaffected. ## 6. Liability We accept no liability for any loss, damage or inconvenience arising from the use of our website or our online enquiry service, unless caused by gross negligence or wilful misconduct on our part. This does not affect liability for injury to life, body or health, or mandatory statutory provisions, in particular those protecting consumers. ## 7. Data protection We process your personal data in accordance with our [privacy policy](https://progreen.lu/en/privacy-policy). ## 8. Changes to these terms We may amend these terms and conditions with effect for the future. Changes are published on our website and take effect upon publication. For appointments already confirmed, the version in force at the time of confirmation applies. ## 9. Governing law and jurisdiction These terms and conditions are governed by Luxembourg law. If the customer is a consumer, they retain the protection afforded by the mandatory provisions of the law of the country of their habitual residence. The courts of the Grand Duchy of Luxembourg have exclusive jurisdiction over any dispute relating to these terms and conditions. For consumers, the statutory rules on jurisdiction apply. ## 10. Out-of-court dispute resolution In Luxembourg, the body responsible for the out-of-court resolution of consumer disputes is the Service national du Médiateur de la consommation: 6, rue du Palais de Justice, L-1841 Luxembourg, [mediateurconsommation.lu](https://www.mediateurconsommation.lu). ## 11. Language versions These terms and conditions are available in French, German and English. In the event of any discrepancy, the French version prevails. ## 12.
